2. Eligibility

You may use our Services only if you are legally permitted to do so under the laws applicable to you.

If you are under the age at which you can independently agree to these Terms in your country, your parent or legal guardian should review these Terms and, where required, agree to them on your behalf.

Parents and guardians are responsible for supervising the use of our Services by children under their care, including any purchases.

3. Licence to Use Our Services

Subject to these Terms, Noeticforce grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to download, install, access, and use our Services for your personal, non-commercial entertainment or other intended use.

This licence does not transfer ownership of any Service or any content contained within it.

You may not:

• copy, reproduce, distribute, sell, rent, lease, sublicense, or commercially exploit a Service except where permitted by law;
• modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of a Service except to the extent that applicable law expressly permits this;
• bypass, disable, interfere with, or circumvent security, advertising, gameplay, purchase, or technical protections;
• use bots, scripts, automation, exploits, modified software, or unauthorized tools to manipulate gameplay, scores, rankings, rewards, or purchases;
• interfere with another user's use of a Service;
• attempt to gain unauthorized access to our systems or third-party systems used by our Services; or
• use a Service for unlawful, fraudulent, abusive, or harmful purposes.

4. Games, Scores, Progress and Virtual Items

Some Noeticforce games may include scores, leaderboards, achievements, virtual currencies, lives, boosts, cosmetic items, unlockable content, power-ups, or other virtual game items.

Unless expressly stated otherwise, virtual items and virtual currencies:

• exist only within the relevant Service;
• have no cash value and cannot be exchanged for real money;
• are not legal tender or financial instruments;
• cannot be transferred between users unless a Service specifically allows it; and
• do not represent ownership of property outside the relevant Service.

You receive a limited licence to use virtual items within the applicable Service. You do not acquire ownership of the underlying virtual item or game content.

We may adjust gameplay mechanics, scoring systems, item availability, balancing, rewards, progression systems, or virtual-item values as reasonably required to operate and improve a Service.

5. In-App Purchases

Some Services may offer optional in-app purchases.

Purchases made through the Apple App Store, Google Play, or another distribution platform are processed by that platform and are subject to its payment terms, refund policies, and account rules.

Noeticforce does not directly receive your complete payment-card or bank-account details for purchases processed through those platforms.

Before completing a purchase, you are responsible for reviewing the price and product information displayed by the applicable platform. All prices, taxes, currencies, and payment methods are determined or displayed through the relevant platform.

Where supported, certain purchases may be restorable using the platform account through which they were originally purchased.

6. Refunds

Refund requests for purchases made through the Apple App Store or Google Play are generally handled according to the refund processes and policies of the relevant platform.

Nothing in these Terms limits any refund, cancellation, or consumer rights that you have under applicable law.

7. Advertising

Some Noeticforce Services may contain advertising, including optional rewarded advertisements.

A rewarded advertisement may allow you to receive an in-game benefit after completing an eligible advertisement. The availability of advertisements is not guaranteed.

An advertisement may sometimes be unavailable because of:

• network conditions or geographic location;
• age or privacy settings and consent choices;
• advertiser availability or advertising-provider restrictions; or
• technical conditions.

Where an advertisement fails to load or cannot be completed, the associated optional reward may not be available. Advertising and related privacy practices are described further in our Privacy Policy.

8. Leaderboards and Achievements

Some Services may use third-party platform features such as Apple Game Center or Google Play Games Services. Your use of those services is subject to the applicable Apple or Google terms and account settings.

We may remove, invalidate, reset, or exclude scores, achievements, rankings, or gameplay results where we reasonably believe they resulted from:

• cheating, exploits, or bugs;
• unauthorized software or manipulated game files;
• automated gameplay or fraudulent activity; or
• other conduct that undermines the integrity of the game or leaderboard.

We may also reset leaderboards or scoring systems when necessary because of major gameplay or scoring changes.

9. Game Progress and Availability

Some game progress may be stored locally on your device.

Unless a Service specifically provides cloud-saving functionality, we cannot guarantee that progress, scores, virtual items, settings, or other locally stored game information can be recovered after:

• uninstalling an application or clearing application data;
• changing, losing, damaging, or resetting a device; or
• experiencing data corruption.

Platform-based purchases, achievements, or leaderboards may be restorable or accessible separately where supported by Apple, Google, or another platform provider.

10. Updates and Changes to the Services

We may update, modify, balance, expand, reduce, suspend, or discontinue all or part of a Service.

This may include changes to gameplay, levels, scoring, difficulty, virtual currencies, virtual items, advertising, visual design, features, platform integrations, online functionality, or technical requirements.

Games and digital services naturally evolve, and we do not guarantee that a particular feature, item, mechanic, reward, score system, or Service will remain available indefinitely. Where required by applicable law, we will respect any rights you have relating to paid digital content.

11. Updates to Your Device

A Service may require updates to continue functioning properly.

Updates may be necessary for new operating-system versions, security, bug fixes, gameplay changes, platform requirements, third-party service changes, or compatibility. Older versions of a Service may cease to function or may no longer receive support.

12. Intellectual Property

The Services and their contents are owned by or licensed to Noeticforce and are protected by applicable intellectual-property laws.

This includes, where applicable:

• software, source code, and game mechanics as protectable under applicable law;
• graphics, artwork, characters, animation, music, and sound effects;
• logos, names, text, user interfaces, and game designs; and
• other creative materials.

Except for the limited licence expressly granted under these Terms, no rights are granted to you in Noeticforce's intellectual property. Third-party names, trademarks, technologies, and content remain the property of their respective owners.

13. Feedback

If you voluntarily send us suggestions, ideas, comments, bug reports, or other feedback about our Services, you allow Noeticforce to use that feedback for purposes such as improving, developing, operating, and promoting our Services.

You are not required to provide feedback. Providing feedback does not give you ownership of modifications or features that Noeticforce may independently develop based on that feedback.

14. Third-Party Services

Our Services may interact with services operated by third parties, including Apple, Google, advertising providers, payment and app-distribution platforms, hosting providers, and other technology providers.

We do not control the operation, availability, content, or independent privacy practices of third-party services. Your relationship with those providers may be governed by separate agreements between you and the relevant provider.

15. Internet and Device Requirements

Some features may require an internet connection, a compatible device, an active platform account, or access to third-party services.

You are responsible for any internet, mobile-data, device, or other charges associated with using our Services. We do not guarantee that every Service or feature will operate on every device, operating-system version, network, or geographic location.

16. Fair Play and Acceptable Use

You agree not to manipulate or misuse our games or Services in a way that harms other users, Noeticforce, our systems, or the integrity of a game.

Prohibited conduct may include:

• cheating or exploiting unintended game behaviour;
• manipulating scores or rankings;
• falsifying purchases or rewards;
• abusing advertising reward systems;
• distributing unauthorized modified versions of our applications;
• attempting unauthorized access to game systems or servers;
• intentionally disrupting a Service; or
• using our Services for illegal activity.

Where reasonably necessary, we may restrict access to online functionality, invalidate scores, or take other proportionate action in response to such conduct.

17. Suspension and Termination

You may stop using a Service at any time and may uninstall it from your device.

We may suspend, restrict, or terminate access to a Service or particular online functionality if reasonably necessary because of violation of these Terms, fraud or abuse, security risks, legal or regulatory requirements, platform requirements, discontinuation of the Service, or circumstances affecting our ability to operate the Service.

Where appropriate and reasonably practicable, we may provide notice before materially restricting a Service.

18. Service Availability

We aim to keep our Services functioning reliably, but we cannot guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable because of maintenance, software defects, server or network problems, third-party service outages, platform changes, security incidents, or circumstances outside our reasonable control.

We may perform maintenance or updates without advance notice where reasonably necessary.

19. Disclaimers

To the maximum extent permitted by applicable law, our Services are provided on an "as is" and "as available" basis.

We do not guarantee that:

• a Service will always be available or completely free from errors or defects;
• every feature will remain available;
• game progress can always be recovered;
• advertisements or leaderboards will always be available; or
• every Service will remain compatible with future devices or operating systems.

Nothing in these Terms excludes warranties, guarantees, or other rights that cannot legally be excluded under applicable consumer-protection law.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Noeticforce Private Limited and its directors, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or similar losses arising from your use of or inability to use a Service where such liability may lawfully be limited.

This may include loss resulting from:

• loss of locally stored game progress, scores, leaderboard position, or virtual items;
• interruption of a Service;
• incompatibility with a device or operating system; or
• actions or failures of third-party platforms or services.

Nothing in these Terms limits or excludes liability where doing so would be prohibited by applicable law, including any rights available to you under mandatory consumer-protection laws.

21. Privacy

Our handling of personal information is governed by our Privacy Policy. The Privacy Policy forms an important part of your relationship with Noeticforce but is separate from these Terms of Use.

22. Governing Law

These Terms are governed by the laws of India, without prejudice to any mandatory consumer rights that may apply under the laws of the country or region in which you live.

To the extent permitted by applicable law, disputes relating to these Terms or the Services will be subject to the courts having jurisdiction in Punjab, India.

Nothing in this section prevents you from exercising rights or remedies available under mandatory consumer-protection law in your jurisdiction.

23. App Store and Platform Terms

If you download or use a Service through the Apple App Store, Google Play, or another platform, your use of that Service is also subject to applicable platform terms.

Where these Terms conflict with mandatory terms imposed by the applicable platform, the mandatory platform terms will apply to the extent of the conflict.

Noeticforce, rather than Apple or Google, is responsible for the Noeticforce Service itself, except for matters that are expressly the responsibility of the relevant platform under its own terms.

24. Changes to These Terms

We may update these Terms when our Services, business practices, platform requirements, or applicable laws change. When we update these Terms, we will publish the revised version at noeticforce.com/terms and update the "Effective and last updated" date above.

Where required by applicable law, we may also provide additional notice of material changes. Your continued use of a Service after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

If you do not agree to an updated version of these Terms, you should stop using the relevant Service.

25. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law. The invalid or unenforceable provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted.

26. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms clearly presented for a particular Service, constitute the agreement between you and Noeticforce concerning your use of that Service, subject to applicable platform terms and mandatory legal rights.
